ICASA - DATA SUBJECT CONSENT FORM
PROTECTION OF PERSONAL INFORMATION ACT 4 OF 2013 (“POPIA”)
Consent to processing and storing information for recruitment, employment, and contracting (Section 18 of POPIA):
1. Storage, Retention, and Destruction of Information:
ICASA uses personal information to comply with legislation and to meet the Authority’s information needs. The data will be stored securely for seven years following the last entry/review, unless public regulations require it to be kept longer.
2. The Reason Why the Information is Required:
2.1 Voluntary: Requested for the Authority’s Functions:
- Perform job history, criminal record, educational/skills qualifications/registrations/licenses, and credit history checks where required and permitted by the National Credit Act.
- Direct communication regarding recruitment opportunities.
- Administer benefits like healthcare and retirement funding.
- Capture timely and accurate information in the Authority’s systems.
- Conduct social media background screening on public platforms.
2.2 Mandatory: Required by Legislation:
- Maintain records required by the Basic Conditions of Employment Act, Employment Equity Act, Skills Development Act, Employment Services Act, and others as applicable.
- Process payments for Skills Development Levies, Unemployment Insurance Contributions, SARS payments, employee benefits, etc.
3. Accuracy of Information and Right to Object:
You must ensure that the information provided is complete, accurate, and up to date. ICASA will handle the processing and security of the information. You may object to ICASA's storage of your information by notifying the Authority and specifying relevant details. ICASA may terminate the agreement if necessary.
4. Storage of Information:
Information will be stored securely in electronic or hard copy format. If stored electronically outside South Africa, it will only be in countries with similar privacy laws or contractually bound facilities.
5. Access to Information:
Data subjects may request access to stored information to verify its accuracy.
6. Complaints:
Complaints can be addressed to the Information Officer at compliance@icasa.org.za or to the appointed POPIA Regulator.
7. Data Subject Consent:
By agreeing to the above, you declare that all information provided is correct, not misleading, and complete. You permit ICASA to collect, process, store, and destroy the information as stated. You may opt-out at any time.
